Terms of Service

By accessing or using t4ndem you agree to these Terms of Service. t4ndem is operated by Embr Holdings ("we", "us", "our"). These terms apply whether you use the service as an individual or on behalf of a household, a team, or a brokerage.

We may update these terms from time to time. If a change is material, we will notify you by email or with a prominent notice in the app before it takes effect. Continuing to use the service after that point means you accept the updated terms.

t4ndem is a shared workspace for buying a home. It lets you and the people you invite keep one list of homes, weigh what matters from must-have to no-preference, plan a budget, and track where you are in the buying process.

Web app

The t4ndem website, where searches are created and managed.

Mobile app

The same searches on iOS and Android, including tour notes and photos.

Companion extension

A browser extension that saves a home from a supported listing site into your search.

We may modify, suspend, or discontinue parts of the service. Where a change removes something you rely on we will give reasonable notice, except where an immediate change is needed for legal or security reasons.

• You need an account to use most of the service. You may create one with an email and password, or with Google or Apple sign-in.
• You must provide accurate, current, and complete information, and keep it up to date.
• You are responsible for keeping your credentials confidential and for everything that happens under your account.
• You must be at least 16 years old to hold an account.
• If you invite collaborators, you are responsible for making sure they use the service in line with these terms.

If you believe someone has accessed your account without authorization, email support@mail.t4ndem.com right away.

t4ndem is currently free to use. There are no subscription fees, and we do not collect payment details.

If we introduce paid plans, we will publish the pricing and give you at least 30 days’ notice before any charge applies to your account, and no charge will be made without your explicit agreement. Paid features will never retroactively lock content you created while the service was free.

You agree not to:

• Use the service to harass, stalk, defraud, or discriminate against anyone, including in violation of fair housing law.
• Add another person to a search, or record their contact details, in a way that violates their rights or applicable law.
• Scrape, bulk-export, or resell property data or other users’ content from the service.
• Use the Companion extension to capture listing data in breach of a listing site’s own terms.
• Circumvent rate limits, authentication, access roles, or other security measures.
• Reverse engineer, decompile, or attempt to derive the source of the service, except where that right cannot be excluded by law.
• Upload malware, or place unreasonable load on our infrastructure.
• Share or resell your account credentials.

We may suspend or terminate an account that violates this section. Where a violation is severe or ongoing, we may do so without prior notice.

Embr Holdings owns the service and everything that makes it up — the software, the design, the t4ndem name and marks, and the documentation. These terms grant you a limited, non-exclusive, non-transferable right to use the service, and nothing else.

You may not use our name, logo, or brand assets to suggest an endorsement or partnership that does not exist.

You keep ownership of what you put into the service: your searches, priorities, budget figures, notes, ratings, photos, and contacts. We do not claim it.

You grant us a limited, non-exclusive, royalty-free licence to store, process, and display that content for the sole purpose of operating the service for you and the collaborators you have invited. That licence ends when you delete the content, subject to the retention periods in our Privacy Policy.

• You are responsible for the content you add and for having the right to add it.
• Your content must not infringe anyone’s rights or break the law.
• You can delete content at any time. It leaves our active systems within 30 days and our backups within 60.

Property details, sale history, tax and HOA figures, and listing status come from public records and third-party data providers. That data is often incomplete, out of date, or wrong, and a listing can change or disappear between one view and the next.

Budget figures the service calculates — monthly payment, cash to close, tax and insurance estimates — are planning estimates only. They are not quotes, not pre-approvals, not appraisals, and not a commitment from any lender, insurer, or agent.

Verify every number that matters with your agent, lender, insurer, title company, or attorney before you rely on it to make an offer or sign anything. We are not liable for a decision made on an unverified figure shown in the service.

A search is shared by design, and access is governed by roles.

Owner

Created the search. Manages members, roles, and deletion.

Editor

Can change priorities, budget, homes, and evaluations.

Agent

A real estate professional invited into the search.

Viewer

Can read the search but not change it.

Inviting someone gives them access to that search’s contents, including its budget and financing details, for as long as they remain a member. Invite deliberately, and remove members you no longer work with. Content contributed by a member stays in the search after they leave, so the remaining members keep an intact record.

An agent or other professional you invite is not our representative. We do not vet, license, endorse, or supervise anyone you bring into a search, and we are not a party to your relationship with them.

Our Privacy Policy explains what we collect and how we handle it. It is incorporated into these terms by reference, and by using the service you consent to the practices it describes.

The service depends on Convex, Cloudflare, Resend, RentCast, and — if you use social sign-in — Google and Apple. Your use of those providers through the service is also subject to their own terms. We are not responsible for their availability, accuracy, or practices, and an outage at one of them may interrupt the service.

The Companion extension interacts with listing sites you visit. Those sites are independent of t4ndem, and your use of them is governed by their terms, not ours.

t4ndem is an organizing tool. It is not a real estate brokerage, mortgage broker, lender, insurer, appraiser, or law firm, and nothing in the service is real estate, mortgage, legal, tax, insurance, or financial advice.

The service is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by law we disclaim the implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that the service will be uninterrupted, timely, secure, or error-free, that defects will be corrected, or that property data shown in the service is accurate, complete, or current.

To the fullest extent permitted by law, Embr Holdings will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost savings, lost opportunity, or loss of data, arising out of or relating to your use of the service — including a home you did or did not buy, an offer you did or did not make, and any figure the service estimated.

Our total liability for all claims relating to the service is limited to the greater of (a) the amount you paid us in the twelve months before the event giving rise to the claim, or (b) 100 US dollars.

Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you. Nothing here limits liability that cannot be limited by law.

You agree to indemnify and hold harmless Embr Holdings and its affiliates, officers, directors, employees, and suppliers from any claim, damage, loss, liability, or expense — including reasonable legal fees — arising from your use of the service, your content, your violation of these terms, or your violation of the rights of anyone else, including someone you invited into a search.

• You may stop using the service and delete your account at any time from your settings.
• We may suspend or terminate an account for a violation of these terms, or for legitimate business reasons on 30 days’ notice. A material violation may result in immediate suspension.
• After termination you have 30 days to export your data before it is deleted from our active systems.

The Intellectual Property, Your Content, Property Data and Estimates, Disclaimers, Limitation of Liability, Indemnification, and Governing Law sections survive termination.

These terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules.

If a dispute arises, contact us first — most things are resolved that way. If it cannot be, the dispute will be settled by binding arbitration administered by JAMS under its rules, seated in Delaware. Either party may still seek injunctive relief in a court of competent jurisdiction, and you may bring a qualifying claim in small claims court.
